RESOLUTION DECLARING INTENT TO PERMANENTLY ABANDON AND CLOSE A PORTION OF THE FORMER LOCATION OF SECONDARY ROAD 1516, BEAUFORT COUNTY, NORTH CAROLINA
WHEREAS, the Beaufort County Board of Commissioners intends to abandon the former location of SR 1516, and it appears that permanently closing this portion of former Secondary Road 1516, the subject area, is not contrary to the public interest and that no individual owning property in the vicinity of said portion of Right-of-Way would be deprived of reasonable access to his or her property; and
WHEREAS, Section 153A-241 of the North Carolina General Statutes prescribes the procedure to be following by a county in order to permanently close a street or alley; and
WHEREAS, the Beaufort County Commissioners have determined that it is advisable to consider permanently closing the former location of Secondary Road 1516 as shown on that NCDOT map attached to the Petition; and
WHEREAS, in order for a municipality to properly and lawfully permanently close a street, Section 153A-241 of the North Carolina General Statutes requires that a Board of Commissioners first adopt a resolution declaring its intent to permanently close the street (or portion thereof) in question and then call a public hearing on the question; said statute further requires that the resolution shall be published once a week for three successive weeks prior to the hearing, and a copy thereof be sent by registered or certified mail to all owners of property adjoining the street as shown on the county tax records, and a notice of the closing and public hearing shall be prominently posted in at least two places along said street or alley; and
NOW, THEREFORE, be it resolved, by the Board of Commissioners of Beaufort County, at its regularly scheduled session of January 9, 2023, that it intends to close the former location of SR 1516 and calls a public hearing on the question to be held at 5:30 pm on Monday, the 6th of February 2023, at 136 W 2nd Street, Washington, NC 27889.
The Clerk of the Board is hereby directed to publish a copy of this resolution in the Washington Daily News once a week for three successive weeks next preceding the date fixed here for such hearing; to transmit a copy of this resolution by registered or certified mail to each owner of property adjoining the above-described portion of former location of Secondary Road 1516; and to cause the prominent posting of this resolution in a minimum of two (2) locations along the portion of former location of Secondary Road 1516 that is proposed for closure, as required by N.C.G.S. 153A-241.
Upon Motion duly made by Commissioner Deatherage, and duly seconded by Commissioner Walker, the above resolution was duly adopted by the Board of Commissioners at the meeting held on the 9th day of January 2023.
